WASHINGTON -- Democrats in the U.S. Senate geared up for a fierce battle over a new healthcare reform plan on Thursday as Republicans condemned the bill's price tag and tax hikes before the first crucial test vote on Saturday. <br />
<br />
<br />
Senate Democratic leader Harry Reid's 2,074-page blueprint for overhauling the &#36;2.5 trillion healthcare system sparked what promises to be a long and bitter debate over President Barack Obama's top domestic priority. <br />
<br />
<br />
The Senate will vote on Saturday night on whether to move to debate on the legislation -- the first key procedural hurdle for the Senate plan and one that requires 60 votes from the 100-member body. <br />
<br />
<br />
"The finish line is in sight," Reid said. "I'm confident we'll cross it soon." <br />
<br />
<br />
Whether Democrats succeed depends on Reid's ability to keep his party's caucus intact. There is no room for error -- Democrats control exactly 60 votes, and Republicans so far are united in opposition. <br />
<br />
<br />
Reid dodged questions about whether he had the votes to move forward, telling reporters, "We'll find out." <br />
<br />
<br />
If the Senate agrees to take up the bill, the debate would begin on November 30, after next week's U.S. Thanksgiving holiday. It would last at least three weeks, making it unlikely Obama can sign a final bill by the end of the year. <br />
<br />
<br />
Any differences between a Senate bill and the House of Representatives version passed on November 7 would have to be reconciled before a final bill can be voted on again in both houses and sent to Obama to sign. <br />
<br />
<br />
The nonpartisan Congressional Budget Office estimated Reid's bill would cost &#36;849 billion over 10 years -- below Obama's &#36;900 billion target -- reduce the budget deficit by &#36;130 billion in the same period and extend insurance coverage to 31 million more people. <br />
<br />
<br />
The rosy report card from budget analysts could ease doubts about the bill among wavering moderate Democrats, but Republicans were not impressed. <br />
<br />
<br />
"We've been warning the American people of the Democrats' plans to raise premiums, raise taxes, and slash Medicare in order to fund more government," Republican leader Mitch McConnell said. <br />
<br />
<br />
CHEAPER THAN HOUSE <br />
<br />
<br />
The Senate bill is less expensive than a more than &#36;1 trillion healthcare measure passed in the House, which would have covered at least 5 million more uninsured. <br />
<br />
<br />
Like the House bill, the Senate measure would require all Americans to buy insurance and would set up exchanges where they could choose among various options. It also would offer subsidies to help low-income workers pay for the coverage. <br />
<br />
<br />
The Senate bill includes a government-run insurance option that lets states choose whether to participate, and would halt industry practices like denying coverage to individuals with pre-existing conditions. <br />
<br />
<br />
Some business trade groups were unhappy about the proposal, including America's Health Insurance Plans, which represents the insurance industry, and the National Federation of Independent Business, which represents small businesses. <br />
<br />
<br />
"The new healthcare taxes and fees will raise the cost of coverage for individuals, families, and employers," said Karen Ignagni, president of America's Health Insurance Plans. <br />
<br />
<br />
Healthcare investors were mostly unconcerned about the Senate bill as most provisions were expected, but a surprise proposal for a 5 percent tax on cosmetic treatments hurt companies such as Allergan Inc and Medicis Pharmaceutical Corp. <br />
<br />
<br />
Republicans criticized tax increases in the bill to help pay for the expanded insurance coverage, including the new tax on elective cosmetic surgery they dubbed a "Botox tax." <br />
<br />
<br />
The bill would also raise the Medicare payroll tax on high-income workers, which is used to finance the government health program for the elderly, and impose a tax on high-cost "Cadillac" insurance plans. <br />
<br />
<br />
McConnell noted some of the bill's deficit reduction was possible because many of its provisions would not kick in until 2014, a year later than in the House bill. <br />
<br />
<br />
"That's a little bit like being asked to pay your mortgage four years before you're allowed to move into your house," he said. <br />
<br />
<br />
Three Democratic senators -- Ben Nelson, Blanche Lincoln and Mary Landrieu -- are uncommitted on Saturday's vote, although Nelson and Landrieu said they were encouraged by Reid's approach. Nelson played down the vote's significance. <br />

"It's a simple vote -- to go forward with debate or not to go forward with debate," he said. "Even if you don't like the legislation, it's arguable you should go ahead. If you don't get it on the floor, you don't have any opportunity to amend it." <br />

<br />
Senator Olympia Snowe, the only Senate Republican to back a healthcare bill in committee, said she would vote with her fellow Republicans to block further debate on Reid's bill. <br />
<br />

"It does weigh in with more taxes and more spending," she told reporters. <br />

The number dwarfs the statistic most people pay attention to-the U-3 rate-which most recently showed unemployment at 10.2 percent for March, the highest it has been since June 1983.<br />
<br />
<br />
<br />
The difference is that what is traditionally referred to as the "unemployment rate" only measures those out of work who are still looking for jobs. Discouraged workers who have quit trying to find a job, as well as those working part-time but looking for full-time work or who are otherwise underemployed, count in the U-6 rate.<br />
<br />
With such a large portion of Americans experiencing employment struggles, economists worry that an extended period of slow or flat growth lies ahead.<br />
<br />
"To me there's no easy solution here," says Michael Pento, chief economist at Delta Global Advisors. "Unless you create another bubble in which the economy can create jobs, then you're not going to have growth. That's the sad truth."<br />
<br />
<span style="font-weight: bold;">Pento warns that forecasts of a double-dip ("W") or a straight up ("V") recovery both could be too optimistic given the jobs situation.<br />
<br />
Instead, he believes the economy could flatline (or "L") for an extended period as small businesses struggle to grow and consequently rehire the workers that have been furloughed as the U-3 unemployment rate has doubled since March 2008.</span><br />
<br />
<br />
<br />
As that trend has happened, the U-6 rate has expanded at an even more dramatic pace. Economists cite several reasons for the phenomenon.<br />
<br />
For one, more workers are becoming discouraged as real estate-the focal point for the expansion in the earlier part of the decade-has collapsed and taken millions of directly related and ancillary jobs with it. <br />
<br />
Many workers believe those jobs aren't coming back, and have thus quit looking and added themselves to the broader unemployment count.<br />
<br />
"In the earlier part of this decade, 40 percent of all new jobs created were in real estate. Attorneys, mortgage brokers, agents, construction-they were all circled around housing," Pento says. "We've had a jobless recovery in the last two recessions. This is going to be the third jobless recovery in a row."<br />
<br />
Another factor that may be leading people onto the rolls of those no longer looking for jobs is the government's accommodative extensions of jobless benefits. <br />
<br />
"Workers are unemployed for a much longer span than we've seen historically," says David Resler, chief economist at Nomura Securities International in New York. "Part of that may be affected by the longer availability of benefits. It reduces the incentives for an urgent job search."<br />
<br />
The U-6 rate debuted in January of 1994 at 11.8 percent, while the U-3 was at 6.6 percent. The measure hit a low of 6.9 percent in April 2000 while U-3 sat at 3.8 percent.<br />
<br />
While the current methodology only dates back 15 years, a former U-6 gauge was in existence previously and peaked at 14.3 percent in 1982. Economists predict the current measure would fall just below that number using the same methodology.<br />
<br />
<br />
<br />
"We're in the process of discovering how severe this recession and the long-run impact on certain industries will be and what that will do to overall employment," Resler says. The U-6 rate "portends a very slow, sluggish recovery." <br />
<br />
If that holds and the US economy stays weak, that presents challenges for investors.<br />
<br />
"People focus too much on that 10 percent number and not on the larger number," says Kevin Mahn, chief investment officer at Hennion &amp; Walsh in Parsippany, N.J. "There's a humongous inventory of people out there looking for work and have been looking for work for a long time. Where are those jobs going to come from?"<br />
<br />
High unemployment and the resulting pressure on consumers is driving many investors to look for opportunities overseas and in other assets.<br />
<br />
Walsh says that trend is going to continue, with clients going to foreign markets, real estate investment trusts, certain bonds-anywhere that can offer profits above the slow-growth mire of US-based investments.<br />
<br />
"If full employment is 4 percent, people are wondering how we're going to get from 10 (percent) to 4. Well, try getting from 17 to 4. We may not get back to full employment for a decade," Mahn says. "As an investor, that causes me to look for different places now. Maybe you can't just put money in US large caps and ride out this recovery."</blockquote>

Senators and witnesses agreed today at Congress' first public inquiry into the Fort Hood massacre that American GIs must immediately report signs of Islamic radicalism among their colleagues to protect the nation's armed forces from inside attacks by lone wolf, self-radicalized gunmen such as the alleged shooter, Army Maj. Nidal Malik Hassan.<br />

The Senate Committee on Homeland Security and Government Affairs signaled that it would urge the armed services to revamp guidelines to encourage troops to report on fellow military personnel because GIs themselves remain the first line of defense against attacks such as the one that took place at Fort Hood on Nov. 5. <br />
<br />
Retired Army Gen. John Keane, the Army's former vice chief of staff, told the panel the Army needed to make changes to help troops identify the "specific behavior and attitudes as expressed by radical Islamists or Jihadist extremists" that would warrant making reports to superiors. <br />
<br />
"It should not be an act of moral courage for a soldier to identify a fellow soldier who is displaying extremist behavior," Keane testified. "It should be an obligation."<br />
<br />
The Senate panel convened hours after National Public Radio released a copy of a personnel evaluation of Hasan by a medical supervisor at Walter Reed Army Medical Center. <br />
<br />
The two-page evaluation by Army Maj. Scott Moran in 2007 said the faculty of Hasan's psychiatry training program had "serious concerns" about the physician's "professionalism and work ethic," adding: "He demonstrates a pattern of poor judgment and a lack of professionalism."<br />
<br />
The memo obtained by NPR was the first public evidence that at least one Army superior tried to bring Hasan's professional conduct to the attention of his chain of command. <br />
<br />
Hasan went before an Army promotion board a year after Scott's evaluation and was recommended for promotion from captain to major - a rank that has suffered acute shortages in the Army medical corps. <br />
<br />
Scott offered his evaluation amid a series of red flags that have come to light since the Fort Hood attack., <br />

Until the Obama administration overturned two centuries of precedence, America had two systems of justice, the civil and the military. The military system played a very small and focused role. It served rough justice in the chaos of war and in places like the open sea in which no nation’s law governed.<br />
<br />
For over two hundred years, those captured by the military outside the civil boundaries or caught carrying out military action on US soil, were tried by military tribunals. Up until the 1950s the military used drum head trials to convict and execute those found fighting in violation of custom and international law. Pirates were often hung at sea within hours of their capture. In WWII, anyone fighting disguised as a civilian faced summary execution with the approval of just three officers. <br />
<br />
For over two hundred years we were careful to keep a firewall between civil and martial law. We did so because civil and martial law are polar opposites. <span style="font-weight: bold;">Civil law is focused on protecting the rights of the accused against the overwhelming power of the state. When there is doubt, the accused walks free. Martial law is focused on imposing a minimal order on bloody chaos. It was focused on allowing the military to complete its mission and win wars. When there is doubt, the accused is presumed guilty.</span><br />
<br />
Now, Obama wants to <span style="font-weight: bold;">bring martial law into a civil court room </span>in Manhattan. In order to let a civil conviction of KSM stand, the higher courts will have to overturn almost all the current constitutional protections of the accused. <br />
<br />
<span style="font-weight: bold;">They will have to overturn the requirement for Miranda warnings. They will have to overturn the Fifth Amendment protection against self incrimination. They will have to overturn the right to face one’s accusers and to examine all evidence and evidence gathering methods. </span><br />
<br />
<span style="font-weight: bold;">Even if the courts throw out his conviction, the government will never allow him to go free, so we will toss out protection against double jeopardy if they try to convict with a military tribunal, and toss out the right of no imprisonment without trial if they don’t. </span><br />
<br />
Our system of justice relies on precedent and equality of procedure. The same rules apply to every civil trail. We can’t say that it’s okay to deny the right against self-incrimination in one person’s trial while saying it’s okay in another. If the courts overturn the rights of one individual accused, it must overturn the rights of all of them.<br />
<br />
Nothing good will come of this trial. <br />
<br />
If it is conducted outside the bounds of normal civil law, it will be nothing but a corrupt show trial whose outcome was preordained by politicians. Instead of showing the world that America is a land of laws in which even our enemies receive fair treatment, it will show the world the opposite. <br />
<br />
<span style="font-weight: bold;">If it is conducted within the bounds of normal civil law, then it will force the courts to choose between letting a mass murdering terrorist walk free and setting dangerous legal precedents that will undermine the basic civil rights of all Americans. </span><br />
<br />
Obama has unleashed something in America far, far more dangerous than any excesses Bush might have committed. <span style="font-weight: bold;">He has taken all the horrible compromises we must make in war and driven them into the heart of the civil legal system. If the courts do not set Khalid Sheikh Mohammed free, the cancer of martial law will metastasize into the entire justice system. </span><br />

We may eventually wish we had never caught the bastard at all. </blockquote>

In the 2009 report, the government officially reported questionable Medicare payments of roughly &#36;36 billion, but that amount will be revised upward to about &#36;48 billion next year as the Health and Human Services Department fully converts to a new methodology that imposes stricter documentation requirements.<br />
<br />
"We need to protect taxpayer dollars," Peter Orszag, director of the Office of Management and Budget, told reporters. "Every dollar that goes to the wrong recipient or in the wrong amount is a dollar not available to help an unemployed worker, or to invest in education or key priorities of the administration."<br />
<br />
Under the executive order, every federal agency would have to maintain a Web site that tracks improper payments, error rates and outstanding payments. If an agency doesn't meet targets for reducing error rates for two years in a row, the agency director and responsible official will have to directly report to OMB to explain the delinquency and new actions they will take.<br />
<br />
The Obama administration will also seek to impose penalties on government contractors that receive improper payments so they have incentives to return the money, Orszag said.<br />

Among the reported waste:<br />

_Agriculture: &#36;4.3 billion in improper payments, or 5.9 percent of total department spending. Much of it was in the food stamp, federal crop insurance and school meals programs.<br />

_Education: &#36;599 million, or 2.1 percent.<br />
