Birmingham City Councilman Joel Montgomery has sued the owner of a parking lot where he said he fell off a wall last year, resulting in a broken nose, fractured vertebra and a public intoxication arrest.
Montgomery's suit said he was injured on April 7, 2007, when he fell 3 feet to the pavement while walking across a wall beside the parking lot.
The lawsuit, filed late Friday afternoon, contends the owners of the parking lot at 13th Avenue South and Richard Arrington Boulevard, failed to maintain it in a reasonably safe condition. The owner, J.H. Berry and Co., also should have warned people about the danger from the dropoff, the suit said.
Birmingham police charged Montgomery, who is chairman of the council's Public Safety Committee, with public intoxication after an officer found him bleeding in the lot near Five Points South about 2:25 a.m. A police incident report said he used abusive language and was jailed that night because he showed he was a danger to himself and others.
The misdemeanor charge was dismissed in Birmingham Municipal Court in August 2007 by a special prosecutor, who said Montgomery had undergone alcohol counseling. Montgomery later denied seeking counseling, and the special prosecutor unsuccessfully tried to reinstate the charge.
