What are you talking about??? These women work hard to get in the shape they're in and I appreciate that hard work. Don't forget, many of the women you see got paid when they voluntarily had their pictures taken. So who is really taking advantage the situation? I know I'm not making any money from those pictures. And what's the difference between what these women are doing and what male body builders do? Don't they both work out just so they can stand around in skimpy bathing suits and have people assess the results of that hard work?

Whilst you might have the privilidge of needing just a few samples to arrive at your decision, I, on the other hand, would prefer as many samples as possible as to be certain I'll make the best decision possible.

ill check. i am a partner in an entertainment management company that is affiliated with a bigger label in miami beach. from my somewhat limited knowledge of this, the use wouldnt fit under the fair use guidelines.

one artist we have helped, brett dennen, had about 25 seconds of his song used in a recent hilton commercial and was paid well for it (http://www.youtube.com/watch?v=NthhizcmEGc).

ill find out who owns master rights and publishing rights to the filter song and if royalties are being paid.

There is no way it is inside the fair free use guidelines. EMI most likely owns it. It's not often a band owns their own recordings. It's authors probably include Richard Patrick, the lead singer.

EDIT: Found the copyright info at US Copyright Office. Sorry, finding this stuff is practically my job. I'd have to make some calls to find out who has licensed it, most likely they'd just ask where its being used and they'd follow through with a takedown. But, there's no reason to be a dick about this. I think he's a big enough one for both sides of the situation.

Raider is absolutely right that this doesn't come close to "fair use" under the copyright statute. Whether he has a license is another story - I have no way of knowing that.
