just something for your info.....posting in all CAPS is the equal to yelling and it is harder to read....not trying to be that guy, but it is difficult on the eyes at time....BTW, the new Tiger Nation logo is pretty cool.....

Good Lord.....all I said, in an earlier thread, was that I really liked that t-shirt, and just for conversation in the middle of a boring day, I asked folks what they thought if THAT was the U. of M. logo....I hope somebody wasn't stupid enough to read what I said, then waste their time calling you up and saying that you were trying to replace the logo....lol.....insane.. :stupid:

The question of whether this will replace the U of M jumping Tiger is irrelevant, since the U of M is the official U of M logo and is trademarked and copyrighted and belongs to the university. How could an individuals artwork, replace a trademarked item? Seems like this is impossible without the U of M making that decision since they own the TM. I think the question was brought up on a previous post of whether the U of M is sanctioning this TIGER NATION effort. FYI, building on the goodwill created by another entity is illegal. You might make sure you have university approval before going much further on this project. I would suggest getting a letter from R C Johnson or the University legal person on this, just to protect yourself. Under federal copyright and trademark law, in order to protect your rights, you must sue those who infringe on it or you can lose your rights. I have been involved in two federal court cases involving infringement of trademark rights I own and it gets pretty expensive. Just remember, you cannot profit on the goodwill created by another trademark right holder.

Dallas, the reason I asked the question was that I would think you could make a strong argument that the Tiger head logo (which I really like, by the way) is an infringement of the diving tiger logo trademark, since it is pretty much the same tiger head without the rest of the logo included (i.e., it is a portion of the trademarked logo). I think you are right...those types of cases could get very expensive.
I hope the University has no problems with this logo, because it looks very good. I was just asking whether they endorsed it.
THE REASON I DID THE LOGO WAS TO TRY AND FIND SOMETHING FRESH THAT THE UNIVERSITY COULD USE. WE ARE GOING TO GIVE IT TO RC AND THE UNIVERSITY.
SINCE THIS IS WHERE THE MAJOR TIGER FANS ARE I WANTED SOME EXPERT ADVISE ABOUT WHAT YOU GUYS THOUGHT OF THE DESIGN AND OVERALL LOOK OF THE LOGO BEFORE WE LET THEM HAVE IT.
I THINK THAT THE FAN INPUT INTO THIS PROJECT IS WHAT MAKES IT WORK. I WENT TRHU ABOUT 15 DIFFERENT GENERATIONS OF THIS SAME LOGO AND OTHER TIGER LOOKS UNTIL I GOT TO THIS ONE. IT REALLY WORKS FOR ME AND ALL WHO HAVE SEEN IT.
I CAME UP WITH THE TOMB OF DOOM IN 1990 FOR THE PYRAMID AND THAT WAS GREAT BUT THIS LOGO CAN BE USED FOR EVERY SPORT AND THE UNIVERSITY IN GENERAL.

I guess one other thing to consider is, after what happened to Steve (which I doubt will happen again), it might be best to keep the U of M informed as to your intentions, which seem very noble to me. However, again, trademark law is pretty strange. FYI, if you allow someone to use your trademark rights without some sort of written agreement, then you have opened the door to others being able to do the same. Just doing nothing and looking the other way, can cause you to lose all your trademark rights. It's almost like you are required to sue an infringer to keep your TM valid and that is EXPENSIVE!! Each one of my law suits in federal court for violations against infringers on trademark's I own, cost me about $50,000 in legal fees alone.

Basically I made some lawyers at Gardere and Wynn Law Firm in Dallas rich and wasted a bunch of time on two court cases that went from temporary restraining orders to injunctions. What a waste of money just to protect a trademark you own.

I really liked the logo on the BAN the BLOB petition a while back. The only place it seemed appropriate.
Personally, when my family and friends see a nice shirt with the blob anywhere on it we just walk away . . . . just my two cents
The blob sucks...I will NEVER purchase anything on which it appears. The only logo we need or should have is the leaping tiger - that's what we are recognized for and we should work to increase this recognition nationwide.
The blob only confuses and makes us LESS recognizable across the country and even in our own back yard.
